According to the EEOC parameters, Fit-for-Duty Medical Assessments may be triggered by knowledge of an employee medical condition that can reasonably be linked to: 1) performance problems, and 2) concern about potential “direct threat”. The knowledge can be gained either by a reliable information from third party that an employee has a medical condition that affects job performance or creates potential direct threat; or by observing behaviors that indicate an employee may have a medical condition that impairs employee’s job performance or creates a potential direct threat.
